Mark C. Davies

Associate

Mark’s practice focuses on complex high stakes litigation. He has represented clients across a range of sectors, such as biotechnology, manufacturing  and  shipping

Mark has particular experience in class actions and matters involving the Anti-Kickback Statute and False Claims Act.  He also has an active pro bono practice which includes a successful amicus brief in a death row case before the Texas Court of Criminal Appeals.

Bull Hill v. HFZ and Monroe

Representing investors in inspection lawsuit to obtain corporate books and records relating to suspected misconduct and mismanagement of assets.

 

Offshore Appraisal Section 1782 Proceedings

Section 1782 discovery proceedings for dissenting shareholders pursuing billions of dollars in offshore shareholder appraisal claims, including in connection with the take-private mergers of SINA, Myovant Sciences, and New Frontier Health.

 

Kaisa Group Holdings

Representing Oasis Management as holder of NY-law governed bonds issued by Kaisa, a Chinese property conglomerate in default on billions of dollars of international obligations.

 

Norske Skog

Defending fraudulent transfer claims in Chapter 15 adversary proceedings brought by the trustee of Norske Skogindustrier, an insolvent Norwegian paper company, relating to a 2016 restructuring.

 

The Trevor Project

Representing The Trevor Project in connection with friend of the court submissions relating to LGBTQ+ rights.

The brief had a positive impact: the Fifth Circuit Court of Appeals affirmed an order from the Arizona District Court preliminarily enjoining the State of Arizona from barring two transgender girls from playing on school sports teams consistent with their gender identity.

    Shireen Barday and Mark Davies Achieve Successful Outcome in Bull Hill v. HFZ and Monroe Case

    Our New York Partner Shireen Barday and Associate Mark Davies have succeeded in fighting off two motions to dismiss in connection with a derivative lawsuit against the real estate empire of HFZ Capital and its lender, Monroe Capital. Currently pending are two motions to dismiss the defendants’ counterclaims along with a motion for sanctions filed on behalf of the investor plaintiffs against Monroe Capital in connection with a frivolous filing by the lender.
