Henrietta Tonkin

Associate

Henrietta is an associate with a particular interest in international arbitration and cross border litigation. She has experience in arbitrations administered by institutions across jurisdictions, including the LCIA, ICC, ACICA and SIAC and acted in cases before the English and Australian courts. This work has spanned numerous sectors including financial services, healthcare, alcohol, energy, and the defence and space industry.

Henrietta is recognised as a key lawyer for Commercial Litigation in Legal 500 UK where she is highlighted as being “an up-and-coming associate” who “is very clever, switched-on and responsive, and a real pleasure to work with.”

Henrietta is qualified to practice in England and Wales and New South Wales (Australia).

Commercial Arbitration

Acting as the lead associate in a USD 500 million commercial arbitration claim under ICC rules, relating to a defence offsetting agreement.

Acting for a pharmaceutical company in a USD 90 million commercial arbitration claim under the ICC rules, relating to the acquisition of a personal hygiene business.

 

Major S90 FSMA Claim

Acting for a significant group of institutional investors in prospectus liability claim against Glencore plc, for amounts in excess of £2 billion.

 

Smile Telecom

Acting for Smile’s majority shareholder and senior lender in respect of two Restructuring Plans, breaking new ground before the English Courts.

 

ClientEarth

Representing ClientEarth pro bono in ground-breaking legal action against Shell’s Board of Directors for their climate risk mismanagement, bringing the first ever case seeking to hold company directors personally liable for failing to properly prepare for the energy transition.
