Our New York Partner and former SDNY prosecutor Josh Naftalis spoke to Law360 following the split verdict in the trial of Tornado Cash developer Roman Storm, a closely watched case that became a battleground for whether developers of autonomous code could be held liable when third parties use their projects to enable criminal activities.
“I don’t think this emboldens the government to bring these cases, because it’s a mixed verdict and generally sort of a loss,” he said. “On the other hand, the defendant was convicted of a crime which will cause developers to sort of pause and see that there is potential liability at least on that statute out there.“
