Kimmie Fearnside

Partner and Pro Bono Lead

Dual qualified in both England and New York, Kimmie maintains a broad commercial and financial litigation practice focusing on high value Court disputes where she frequently litigates before the High Court and on appeals. Kimmie also has experience in complex international arbitration matters, with expertise of LCIA and ICC rules, as well as acting investor-side in an investment treaty challenge. Kimmie is adept in advising and acting in matters relating to allegations of fraud, misrepresentation and breach of warranty claims, and a range of corporate disputes including breaches of director duties, shareholder disputes, and securities-related actions.

Shortlisted as a ‘Rising Star’ for Litigation at the 2024 Women in Business Law Awards and recognised as a key lawyer for Commercial Litigation in Legal 500 UK, Kimmie is seen as a trusted advisor in a broad spectrum of advisory matters, particularly in the shareholder activism space and matters relating to listed investment companies.

In addition to her fee-earning caseload, Kimmie leads the firm’s award-winning pro bono practice, spearheading the strategic direction for the firm’s pro bono and broader community investment initiatives. As part of her role, she also takes on pro bono cases, including those that focus on her personal interests in climate change and international human rights law issues. As a solicitor advocate, Kimmie represents litigants on a pro bono basis in the Chancery Division of the High Court.

Since 2018, Kimmie has sat as a trustee of her alumna college Junior Combination Room (JCR).

Major S90 FSMA Claim

Acting for a significant group of institutional investors in prospectus liability claim against Glencore plc, for amounts in excess of £2 billion.

ClientEarth

Representing ClientEarth pro bono in ground-breaking legal action against Shell’s Board of Directors for their climate risk mismanagement, bringing the first ever case seeking to hold company directors personally liable for failing to properly prepare for the energy transition.

Australis Seafoods

Acting for the Chilean former owners of Australis Seafoods S. A., a salmon producer located in Chile, in the English civil claim brought by the new owners in a dispute over the US$900 million sale.

Insolvency-related investigations and litigation

Acting for the administrators on the investigation into the collapse of a leading international distribution company.

Claimant in Misrepresentation Proceedings

Acting for Parsdome Holdings in English litigation concerning misrepresentations made in the context of negotiations to settle a convertible note.

Third party intervention

Acting for the Association of Litigation Funders in its application to intervene as a third party in the Court of Appeal and subsequently in the UK Supreme Court proceedings concerning the validity of funding agreements.
