Our New York Partner Shireen Barday and Associate Mark Davies filed an amicus brief on behalf of the The Trevor Project in connection with a challenge to a transgender sports ban in Arizona.
The brief had a positive impact: the Fifth Circuit Court of Appeals affirmed an order from the Arizona District Court preliminarily enjoining the State of Arizona from barring two transgender girls from playing on school sports teams consistent with their gender identity.
In reaching this conclusion, the Fifth Circuit panel held that Arizona’s transgender ban discriminates on its face based on transgender status and that the State Superintendent and several legislators were unlikely to establish that the law’s sweeping ban was substantially related to the achievement of the State’s governmental objectives in ensuring competitive fairness and equal athletic opportunity for female student-athletes.
