Our New York Partner and former SDNY prosecutor Josh Naftalis shares his thoughts with GIR about the potential impact of a whistleblower lawsuit on Freepoint Commodities’ deferred prosecution agreement (DPA) with the DOJ. The whistleblower, a former employee, alleges that the company pressured him to conduct illegal insider trading and then retaliated against him when he pushed back. Josh explained that the lawsuit puts the company “back in the spotlight” and could impact any attempts to have the DPA dismissed before its scheduled end in 2026.
