Fiona Huntriss and Tracey Dovaston Speak to Legal Business on the Ethics of Litigation Funding

Our partners Fiona Huntriss and Tracey Dovaston sat down with Legal Business to discuss the intricate balance between protecting legitimate claims and preventing abuse within the legal system.

Tracey emphasised the importance of maintaining a robust framework in order to ensure access to justice for all. She commented that “In order to get funding you have to be able to show the merit of the claim. What you’ll find when they’re spurious is that they get thrown out at the early stages.”

Fiona pointed to a further safeguard within the United Kingdom legal system that prevents spurious claims and differentiates the UK from North America, “England is a loser-pays jurisdiction, so there’s a built-in safeguard against spurious claims. I don’t think England is susceptible to a rise in spurious claims, due to adverse costs.”
